Terms of service
The rules of using Brownie Helps.
These Terms of Service (“Terms”) govern your purchase and use of Brownie Helps’ services: the installs, monthly retainers, and the client portal at browniehelps.com. By purchasing a plan, signing an order form, or creating an account, you agree to these Terms. Paid engagements are additionally governed by the Client Services Agreement, which you accept at checkout (or by signed order form) and which controls if the two conflict.
1. What we do
Brownie Helps installs and operates growth-operations automations (“Brownies”) for your business — website/landing pages, outbound sales, and lifecycle/nurture, among others depending on your plan. The specific scope for your engagement is set during intake and confirmed in your order (a statement-of-work style summary of what’s included). Anything outside that scope is available as a paid add-on, not included by default.
2. Fees & billing
- Plans generally combine a one-time install fee (the initial build) and a recurring monthly retainer (ongoing operation), billed through Stripe. Some products are one-time only (e.g. a paid audit or Launch Support).
- Plans with a monthly retainer have a 3-month initial term(set out in the Client Services Agreement), then renew automatically month-to-month until cancelled with 30 days’ notice. Cancellation stops future charges after the notice period; it does not refund the current period.
- No refunds on completed install work.Once we have delivered the agreed install milestone (e.g. a live landing page, a configured Brownie), that fee is earned and non-refundable. If we have not yet delivered the install, contact us and we’ll work it out in good faith.
- Failed or disputed payments may pause active Brownies until resolved.
- Prices are as shown on our pricing page or in your order at time of purchase; we’ll notify active clients before any retainer price increase takes effect.
3. Ownership
- Your deliverables.Once you’ve paid in full for a specific deliverable built for you (e.g. your website, your brand kit, your copy), it’s yours to keep and use, including if you later stop working with us.
- Our platform & IP.Brownie Helps retains all rights to the Brownies themselves — our automations, prompts, playbooks, internal tooling, and the platform/software that runs them. You’re buying the outcome of that system running for you, not a license to the system itself.
- Your business data, brand assets, and intake information remain yours; we use them only to operate your engagement.
4. Approval gates on outbound
Anything that goes out under your name or brand — outbound emails, social posts, LinkedIn messages, ad copy, and similar — runs through an approval step before it sends, at the cadence agreed during intake (per-message, batched, or scheduled review). We don’t send on your behalf without that gate unless you’ve explicitly turned on a fully-automated mode for a given channel.
5. Channel & account connections
Where a Brownie needs access to a platform you use (a social account, an ad account, an ESP, a CRM like GoHighLevel, or similar), you connect it via that platform’s own OAuth sign-in. You can revoke that access at any time from the portal or from the platform’s own settings. You’re responsible for maintaining good standing on any third-party platform you connect (their terms still apply to your account there).
6. No guaranteed results
We build and operate real systems and put real effort behind them, but we do not guarantee specific results — revenue, audience growth, conversion rates, deliverability, or rankings. Outcomes depend on your market, offer, existing audience, and many factors outside our control. Nothing on our site or in a sales conversation is a guarantee unless it’s written into your specific order.
7. Term & termination
- Monthly retainers run for a 3-month initial term, then renew month-to-month until either party cancels with 30 days’ notice (see the Client Services Agreement).
- You may give notice of cancellation at any time from your billing page or by emailing billing@browniehelps.com; it takes effect at the end of the initial term or, after that, at the end of the notice period. Access to active Brownies continues through the end of the paid period.
- We may suspend or terminate service for non-payment, misuse (e.g. directing outbound in violation of a connected platform’s policies or the law), or breach of these Terms, with notice where practical.
- Sections on ownership, fees already earned, and limitation of liability survive termination.
8. Confidentiality
We treat your business information, intake answers, and connected account data as confidential, and use them only to operate your engagement.
9. Limitation of liability
To the maximum extent permitted by law, Brownie Helps’ total liability for any claim arising from these Terms or our services is limited to the amount you paid us in the three months before the claim arose. We’re not liable for indirect, incidental, or consequential damages (like lost profits) arising from the services.
10. Governing law
These Terms are governed by the laws of the State of California, without regard to conflict-of-laws principles.
11. Changes to these Terms
We may update these Terms as the service evolves. We’ll post the updated date below and, for material changes, notify active clients.
